Two new implementing regulations under Law 18/2009 were recently issued by the Government of Indonesia for the import of carcasses, meat, edible offals and processed products of animal origin.

Those are Minister of Agriculture No: 50/PERMENTAN /OT.140/9/2011 dated September 7, 2011 and Minister of Trade No. 24/M-DAG/PER/9/2011 dated September 7, 201 General Information: NEW REGULATION ON THE APPROVAL FOR THE IMPORTATION OF CARCASSES, MEATS, EDIBLE OFFALS AND PROCESSED PRODUCTS Two related regulations were issued by the Government of Indonesia. There include: 1. Minister of Agriculture No: 50/PERMENTAN /OT.140/9/2011 dated September 7, 2011 on Recommendation for Approval of Import Carcasses, Meats, Edible Offals and Processed Products. As stated in the regulation, it became effective as of October 1, 2011. 2. Minister of Trade No. 24/M-DAG/PER/9/2011 dated September 7, 2011 concerning Provision on the Import and Export of Animal and Animal Product. As stated in the regulation, it became effective as of October 1, 2011. The regulations are implementing regulations under Law 18/2009 on Animal Husbandry and Animal Heath. However, there does not appear to be any plans to notify the WTO. However, there was a commitment made by Ministry of Trade officials to coordinate an interagency briefing for officials from U.S. Embassy-Jakarta. To date, that has not yet occurred. Regulation No: 50/PERMENTAN /OT.140/9/2011 was issued to replace the Minister of Agriculture regulation No: 20/PERMENTAN/OT.140/4/2009 on the Importation and Distribution Control of Carcasses, Meats, and/or Edible Offals from Overseas. The key points of the new regulation, No: 50/PERMENTAN /OT.140/9/2011 includes the following unofficial English translation: Import of carcasses, meats, edible offals and/or processed products can be performed after obtaining the import permit(s) (SPP) from the Ministry of Trade. The permit(s) will be released after obtaining Import Approval Recommendation (RPP) from the Ministry of Agriculture (Article 2). The RPP is issued by the Director General of Livestock and Animal Health Services (DGLAHS) on behalf of the Minister of Agriculture to the importer. The RPP should indicate the allocation is intended for use in hotel, restaurant, catering, or food processing sectors (Article 3). Issuance of RPP is conducted in 2 (two) periods during the course of a year: for the first semester period (January 1 to June 30) the RPP application should be submitted between August 15-September 15. For the second semester period (July 1 to December 31) the RPP application should be submitted between February 15 - March15 (Article 5 & 26). End Comment) Imports of carcasses, meats, edible offals and/or processed products are based on the national demand analysis which is determined by a multi-stakeholder meeting coordinated by the Coordinating Ministry for Economy Affairs through input from the Ministry of Agriculture and/or related Ministries (Article 4). Designation of an exporting country as an eligible country of origin of carcasses, meats, edible offals, and/or processed products is carried out by the DGLAHS on behalf of the Minister, after obtaining advice and opinion from the Indonesian Country of Origin Assessment Team. The Assessment Team is comprised of representatives of the DGLAHS and the Agricultural Quarantine Agency (Article 12). End Comment) Business unit/establishment of the country of origin must have system of halalness guarantee, and only perform halal practices (fully dedicated to halal practices), and have officers who become permanent employees and perform supervision over slaughtering, handling, and processing in halal manner and being controlled and supervised by Indonesian Council of Ulama (MUI) (Article 15). Designation of business unit/establishment as an eligible supplier of carcasses, meats, edible offals, and/or processed products is carried out by the DGLAHS on behalf of the Minister, after obtaining advice and opinion from the Business Unit Assessment Team. The assessment is based on review of the questionnaire followed by a plant audit (Article 16). ( FAS Jakarta Comment: The Assessment Team currently consists of technical experts and DGLAHS staff. It is not clear if the previous practice of pre-listing an establishment based on document review will be continued. End Comment) Label on package must use Indonesian and English language and contain of the following (Article 17): a. destination country Indonesia; b. establishment Number; c. slaughtering date and/or production date; d. quantity, type, and specification of carcasses, meats, edible offals, and processed products thereof; e. intended use: food or feed; and f. halal label for products requiring such a label. Attachment II includes a list of duck and turkey products that can be imported, and limits those imports to whole duck/turkey. The absence of any chicken products implies the regulation effectively bans imports of any chicken products including whole chicken, chicken parts, and MDM poultry. Terminology: 1. Processed Meat is meat processed by a specific system or method, with or without additive, performed in halal and proper manner so it is worthy, safe, and fit for human consumption. 2. Edible Offal is limited to heart and liver derived from large ruminant. 3. Import Approval Recommendation, hereinafter called RPP, is a written statement given by the Minister or his authorized official to the importer who will import carcasses, meats, edible offals, and/or processed products thereof to Indonesian territory. The RPP is needed before obtaining the SPP. The key content of the Minister of Trade regulation No. 24/M-DAG/PER/9/2011 is: Imports of live animal and animal products may only be conducted if domestic production and supply of animal products are not adequately available for public consumption at reasonable prices. National allocations for imported live animals and beef (see attachment II of this decree) are issued every year based on the results of a Coordination Meeting at the ministerial level in consideration of domestic production and demand. Import allocations of live animal and beef products for each Registered Importer (IT) are conducted every semester based on the results of the Coordination Meeting at the Echelon I level in consideration of the total annual allocation. The import allocation is based on the capacity of the importer’s temporary animal quarantine installation; maximum load capacity; and past performance value (Article 3). Imports of live animals and/or animal products may only be conducted by a company that has obtained IT certification (see attachment I of this regulation). This certificate is only valid for two years and can be extended (Article 4). IT-Animal and Animal Product must obtain an Import Permit (SPP) from the Minister. The Minister delegates authority on the issuance of Import Permit(s) to the Director General on behalf of the Minister. To obtain Import Permit(s), IT-Animal and Animal Product needs an RPP from the Minister of Agriculture or officer authorized by the Minister of Agriculture for import of live animal and/or animal products; or recommendation from Head of the Drug and Food Control Agency or his officer authorized by Head of the Drug and Food Control Agency for import of processed animal products; and recommendation from the Minister of Agriculture or officer authorized by the Minister of Agriculture for import of processed animal products that possesses risk of zoonosis spread (Article 5). Imports of carcasses, meats, edible offals, and or processed products are only for industry, hotel, restaurant, catering, and/or other specific uses (Article 7). Note: This limits distribution to the retail sector Import Permit(s) number must be stated on the Health Certificate issued by the Country of Origin. (Article 8). Terminology: 1. Registered Importer of Animal and Animal Product, hereinafter called IT-Animal and Animal Product, is a company performing import of animal and/or animal product for the purpose of business activity by trading or transferring goods to another party. 2.
