Russia’s TRQ volumes appear consistent with its WTO commitments. The EEC Decision shall enter into force 30 days from the date of its official publication (i.e., December 21, 2012). Summary On November 21, 2012, the Eurasian Economic Commission published Decision 229 , “On the List of Goods, which are Subject to Tariff-Rate Quotas in 2013, and the Volume of Tariff-Rate Quotas for Imports of these Goods into the Member States of the Customs Union and Common Economic Space.” The Russian TRQ volumes for 2013 were adjusted to meet Russia’s WTO commitments. For example, Russia provides additional in-quota market access for fresh and chilled beef (from 33,330 MT in 2012 to 40,000 MT in 2013), additional in quota market access for poultry (from 341,330 MT in 2012 to 364,000 MT in 2013), and has established a TRQ for imports of whey (15,000 MT in 2013). Country-specific TRQ allocations were made for Russian frozen beef imports (EU {60,000 MT}, USA {60,000 MT}, Costa Rica {3,000 MT} and other WTO Member States {407,000 MT}), Russian fresh and chilled beef imports (i.e., EU {29,000MT} and other WTO Member States {11,000 MT}), as well as Russian frozen de-boned chicken imports (i.e., EU {80,000 MT} and other WTO Member States {20,000 MT}). Kazakhstan provided increased in-quota access for fresh, chilled, and frozen beef (from 13,920 MT in 2012 to 15,400 MT in 2013) and increased in-quota access for fresh, chilled, and frozen pork and pork trimmings (from 9,400 MT in 2012 to 9,700 MT in 2013). However, Kazakhstan reduced the TRQ volume for poultry (from 110,000 MT in 2012 to 100,000 MT in 2013). The Belarus TRQ for fresh, chilled, and frozen beef was eliminated (from 5,000 MT in 2012 to 0 MT in 2013), the in-quota volume for fresh, chilled, and frozen pork and pork trimmings was reduced (from 60,000 MT in 2012 to 47,200 MT in 2013), as was the in-quota volume for poultry (from 15,000 MT in 2012 to 10,900 MT in 2013). Begin Unofficial Translation of Decision #229 DECISION November 20, 2012 No. 229 Moscow On the List of Goods, which are Subject to Tariff-Rate Quotas in 2013, and the Volume of Tariff- Rate Quotas for Imports of these Goods into the Member States of the Customs Union and Common Economic Space The Collegiums of the Eurasian Economic Commission has decided: 1. To approve attached List of Goods, which are Subject to Tariff-Rate Quotas in 2013, and the volume of tariff-rate quotas for the import of these goods into the Member States of the Customs Union and Single Economic Space (hereinafter – the List). 2. To establish that the tariff-rate quotas, specified in the List, apply to goods imported to the unified customs territory of the Customs Union and placed under the customs procedure of release for domestic consumption, with the exception of goods originating in and imported from the CIS member-states. 3. To distribute between third countries the volume of tariff-rate quotas for the import of certain types of agricultural goods into the territory of the Russian Federation as follows: a) in respect of meat of bovine animals, fresh and chilled (CU HS Code 0201): European Union member-states – 29 thousand tons; other states – members of the World Trade Organization – 11 thousand tons; b) in respect of meat of bovine animals, frozen (CU HS Code 0202): European Union member-states – 60 thousand tons; United States of America – 60 thousand tons; Republic of Costa Rica – 3 thousand tons; other states – members of the World Trade Organization – 407 thousand tons; a) in respect of frozen deboned chicken meat (CU HS Code 0207 14 100 1): European Union member-states – 80 thousand tons; other states – members of the World Trade Organization – 20 thousand tons; 4. To request the member-states of the Customs Union and Single Economic Space (hereinafter – member-states): to implement distribution of the volumes of tariff-rate quotas in 2013 among foreign trade participants in accordance with their legislation; to instruct the authorized bodies to issue licenses for the import of goods, which are subject to tariff-rate quotas. 5. Following adoption of the Protocol on Amending the Agreement on the Terms and Mechanism for Application of Tariff-Rate Quotas of December 12, 2008, the member of the Collegium (Minister) for Trade A.A.Slepnev shall take measures to immediately organize consultations with authorized representatives of the member-states in order to distribute additional volumes of tariff-rate quotas in 2013 for the import of goods, specified in the List, into the territory of the member-states within the limits determined by articles 3 and 4 of the states Agreement. 6. This Decision shall enter into force 30 days from the date of its official publication.
